Privacy Policy

  1. Description.

    This Privacy Policy (“Policy”) describes how Simmr, Inc. (“Simmr” or “we” or “our”) treats information collected or provided in connection with an end user’s (“you” or “User(s)”) use of the Simmr website at http://www.simmr.co (the “Site”) that connects Users to local business (the “Venues”).

    1. NOTE:

      Simmr does not knowingly collect information from children under 13 and the Site is only intended for Users who are at least 18 years of age. If you are a parent and believe that your child under the age of 13 has used the Site and provided personally identifiable information to us through the Site, please contact us at hello@simmr.co.

  2. Effective Date; Changes.

    This Policy was last updated on the date at the top of this page (“Effective Date”). The Policy applies to all information collected by or provided to us by the User on and after the date Effective Date. When we make any material changes to this Policy, we will change the Effective Date above. We will seek your affirmative consent prior to applying any material change to this Policy that governs the use of information we have already collected or received prior to the date of the change. Material changes may include those that affect how we use or disclose personally identifiable information.

  3. Third Parties.

    We may offer through the Site or send to registered Users links to or offers from Venues and other third parties. This Policy does not apply to information that you may provide to or that may be collected by Venues or other third parties. We encourage you to request Venues and other third parties to provide you with their applicable privacy policies and other terms and conditions before registering for an event, engaging with or making a purchase from such Venues or other third parties.

  4. Collected Information.

    1. Information You Submit.

      When you log-in to or create an account on the Site, we collect the personally identifiable information you provide in the applicable form. This information includes but is not limited to your name and e-mail address.

    2. Social Networking Information.

      You can log-in to the Site through your Facebook account (“Social Media Account(s)”). Integration with Social Media Accounts allows us to offer a more personalized experience to you when you use the Site. When you log into the Site using your Social Media Accounts, we will receive the e-mail address and information relating to your Social Media Accounts that you make available to us (such as your name, date of birth, and current profile picture), and we will use, store and disclose such information in accordance with this Policy. We may give you the ability to invite your Social Media Account connections to use the Site, notify your connections when you register for the Site or an event and, with your permission, post information regarding your Site usage to your Social Media account.

      Please remember that the manner in which a Social Media Account provider uses, stores and discloses your information, including the extent to which the provider discloses it to us, is governed by the terms and conditions and privacy policies of that provider, and not Simmr.     3. Information Collected When You Use the Site.

      When you use the Site, we gather certain non-personally identifiable information from you, and this information can be associated with the personally identifiable information that you provide. This includes usage information, such as information on when, how often and for how long you use the Site, as well as server log data such as a computer’s IP address, browser type or the webpage you were visiting before you came to our website.

  5. Cookies.

    “Cookies” are small text files containing a string of alphanumeric characters that are downloaded by your web browser when you visit a web site. The use of cookies is very common. We may use both session cookies and persistent cookies when you access and use the Site. Cookies are used to remember your User account information, your preferences, and customize the interface of the Site for you. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Site. Persistent cookies can be removed. Please review your web browser’s documentation to learn the best way to modify your cookie settings.

  6. Use and Disclosure of Information.

    1. We internally use the information we maintain about you as follows:

      1. We will use submitted information for the purposes for which you provided the information, including, for example, to create and maintain an account for you and to contact you via e-mail regarding events you have signed up for using the Site.

      2. We may use submitted information and collected information to personalize the content that you and others see based on personal characteristics or preferences. For example, we may use your mailing address information in order to show you events at Venues that are located nearby.

      3. We may analyze collected information in order to help us improve the Site and develop and improve other products and services.

      4. We may send you a newsletter or other e-mail communications relating to the Site. To the extent we send you an e-mails containing third party promotions or offers, those e-mails will contain instructions for opting-out of such e-mails in the future to the extent required under applicable law.

      5. We may use submitted information and collected information to help troubleshoot problems, provide you with required notices, enforce our User Agreement, or to alert you to changes in our policies or agreements that may affect your use of the Site.

    2. We use and disclose the information we maintain about you as follows:

      1. Other Site users will see your profile picture, profile information, the events you register for and the Venues you follow.

      2. We may provide third parties with aggregated, non-identifiable information about our User base and its interests and usage patterns, for industry analysis, demographic profiling and other purposes.

      3. We may disclose non-personally identifiable information to third party partners in furtherance of our business arrangements with them, including without limitation to jointly offer a product or service to you or create interoperability between our products and services and the products and services of such partners.

      4. When you register for an event with a Venue, we will provide the Venue with you name. In addition, we may provide a Venue with other, non-personally identifiable information regarding users who have registered for events at that Venue.

    3. Simmr uses contractors and third party service providers to provide the Site to our Users. When our contractors or service providers obtain access to your information, they are required to protect this information in a manner that is consistent with this Policy by, for example, not using the information for any purpose other than to carry out the services they are performing for Simmr.

    4. We will use and disclose information where we, in good faith, believe that the law or legal process (such as a court order, search warrant or subpoena) requires us to do so or in other circumstances when necessary either to protect the rights or property of Simmr, our Users, and third parties.

  7. Viewing and Amending Information.

    You can log into your account on the Site and view your User account information at any time. Information the Site receives through your Social Media Account may only be changed by changing it on the applicable Social Media Account website.

  8. Advertising.

    The Site may include advertising provided by third party advertising services providers. These providers and their partners may use cookies, beacons and other technologies in connection with targeting, serving and measuring the performance of their advertising, including for purposes of targeting advertisements based on a user’s browsing behavior.   9. Choices Regarding Third Party Offers.

    To the extent we send you commercial e-mails regarding third party marketing or promotional materials, we will give you the ability to opt-out of receiving such e-mails in accordance with applicable law. We will not provide your personally identifiable information to third parties for their own marketing purposes without your consent.

  10. Security.

    The personally identifiable information we collect about you is stored in limited access servers. We will maintain reasonable safeguards to protect the security of these servers and your personally identifiable information. However, no security measures are 100% effective and we cannot guarantee the security of your personally identifiable information.

  11. Transfer As Corporate Asset.

    In the event of a merger, sale of capital stock or assets, reorganization, consolidation or similar transaction involving Simmr, the information we possess (including personally identifiable information) shall be transferred as a corporate asset to the acquiring entity, provided that such entity will continue to handle such information in accordance with this Policy.

  12. Transfer to the U.S. or other Countries.

    Simmr is established in and uses facilities in the United States. Your information will be stored and processed in the United States or other countries where Simmr has facilities. If you live outside of the United States, by using the Site you consent to the transfer of information outside of your country, even if your country has more rigorous data protection standards.
